Hi,
I just found this forum and it is really nice place to get some practical information from people gone through all this. I will be applying for Adjustment of Status as I am getting married to a US citizen and I am not. The only thing that I cannot figure out for now is:
Do I have to fill out I-130 and submit it along with the I-485? I am currently on H2B visa in the usa, never been out of status just extended my stay a couple of times. I have my I-94. Also my H2B will expire end of September. Do I have enough time by then to fill out my papers so I do not get out of status. I am getting married by the end of August.

I am waiting for the approval of my I-131. Can I fax a request to approve/speedup the process? If I can send the fax, can someone pass the fax number?
Background:
I applied for I-131 online in May, 2008 at TEXAS Service center. I applied before 120 days of the expiration. In December 2008 I got an RFE asking for the reasons why I applied before 120 days of expiration of AP authorization. I sent the response on Dec 11th.

I have a problem. My Employer want to know how long it`s take to become the EB3 Visa, I meen after PERM, I-140. I`m from Germany. I have read that it`s take 4 years till a visa will be available. It`s really so?

Spouse I-485 Receipt Notice.
Applied I-485 for my wife in the first week of September (8th Sept) when the dates became current, but haven't received the receipt
number yet.
I got an RFE (EVL) on my application which I submitted on 21 Sept. USCIS received the response on 22nd Sept and updated the case.
I am little worried that whether USCIS has received her application or not. Is there a way to find out, whether I can open an Service request or take an Info Pass regarding this?
Any suggestions will be helpful.

I am in 7th yr of my H1B and I have got 3 yrs extension on my H1B after
completing my 6 yrs. I have got my labour appliation and I-140 approved 1 year back and filed my I-485 in MAR'2005. My PD is Jan 2002, India EB3.
In SEP'2005, I got married and my spouse came to this country on H4 Visa.
Because of retrogresion.I couldn't file I-485 for my wife. Now I am waiting for my PD to get current to file 485 for my wife.
My question is, Can I change my employer by doing H1B Transfer. So that my
spouse wont be losing H4 Status. Also, when my PD becomes current can I ask my new employer to file 485 application for my spouse.
My lawyer has told me that filing Spouse's 485 has to be done with the same
employer who filed your application. Is it true? or Can I change my employer.

Do you know where your congressman is? Until recently, few aside from staffers could have answered �yes.� But under increased pressure from watchdogs and the public, more lawmakers are disclosing with whom they�re meeting, as well as when and where.
Rep. Kirsten Gillibrand (D-N.Y.) is a case in point. For instance, she had two hectic days of meetings, receptions and fundraising events at the end of May.
On May 30, she met with American Insurance Group (AIG) officials, attended a meeting with Goldman Sachs employees to discuss sub-prime lending and alternative energy policies, sat down with Altria Group lobbyists to discuss tobacco regulation, and joined some of her business-friendly Democratic colleagues to meet with Morgan Stanley executives.
She then hopped on a plane for a two-day fundraising swing through San Francisco and Los Angeles, where she attended a fundraiser with Sen. Hillary Rodham Clinton (D-N.Y.) and raised money for herself.
This information normally is hard to come by for a reporter or government watchdog group. But during last year�s campaign, the Sunlight Foundation, a new watchdog, challenged lawmakers and candidates to publish their official work schedule online within 24 hours of the end of the workday.
�My sixth sense about this is that greater transparency is an antidote to corruption and members of Congress get that,� the executive director of the Sunlight Foundation, Ellen Miller, said. �[California Republican Rep.] John Doolittle is a case in point. We�re at the tip of the iceberg. More and more will do it as citizens begin to understand it.�
Gillibrand agreed to make her calendar public during the 2006 campaign, making it easier to see how she is using her time. Sen. Jon Tester (D-Mont.) also started posting his schedule when he arrived in Washington even though he did not sign the pledge, his spokesman Matt McKenna said.
For Tester, open government is �a way of life in Montana,� McKenna said, adding that the reaction �has been all positive.�
Six more lawmakers, Reps. Alcee Hastings (D-Fla.), Kathy Castor (D-Fla.), Jan Schakowsky (D-Ill.), Denny Rehberg (R-Mont.) and Doolittle and Sen. Bill Nelson (D-Fla.), have followed suit.
The calendars provide a glimpse into the harried lives of the lawmakers, showing with whom they meet and how they manage their time and highlighting differences between the House and Senate.
They also allow observers to link campaign donations to meetings.
Gillibrand flew to Palo Alto, Calif., on May 30. A week earlier she gave $4,600 to Clinton�s presidential campaign. On June 2, Gillibrand met � the calendar does not say where � with Jayne Shapiro, a wealthy businesswoman, who gave $500 to the campaign. Gillibrand also met with Marsha Kwalwasser, an executive at Northrup Grumman, according to CQ Moneyline.
Reporters and constituents love publicly posted schedules, and so do opposition researchers. MajorityAP.com, a Republican Web-based research service that provides information to reporters about Democratic lawmakers, accused Gillibrand of misleading the public by not stating where the event took place.
�It�s reasonable that the people in her district know that she�s in California raising money during the Memorial Day recess,� the website�s founder, Michael Brady, said.
A spokeswoman for Gillibrand said the missing location was a simple oversight, adding that Gillibrand�s office would look into adding the location.
Miller said Tester�s schedule should be the standard that lawmakers emulate, but that more disclosure is better than none.
Tester shares the same frenetic pace as Gillibrand, traveling, presiding over the Senate, sitting in committee hearings, meeting with constituents and huddling with Sen. Max Baucus (D-Mont.).

Most lawmakers do not archive their schedules, although Congresspedia does.

Years of congressional inaction and paralysis on immigration reform have created an untenable situation that, depending on which �side of the fence� one sits on the Arizona immigration law debate, has either forced the Arizona legislature to take necessary action or permitted overzealous lawmakers to trump federal authority. I am on H1-B Visa and my wife on H4. She filed for GC in Schedule A(I140&I485 filed concurrently) category. Her I140 is not approved yet. We both got our EAD cards but have not worked using our EADs. I do not intend to use my EAD to work. Our question is:
* If her I-140 gets denied will she still have her H4 status as I am still maintaining my H1?
* If not, how can she get back to H4 status? Will she be asked to leave the country immediately?
Need immediate reply.

Hi! My company is moving to another address. My I-140 was filed on July 2, 2007 (USCIS receipt date August 20, 2007). My H-1B 6th year will end on July 1, 2009. My lawyer wants to file for the change of address and the H-1B extension together. He is asking for about $2k+ for self and family (incl atty fee and filing fees).
Is the change of address on H-1B that big a deal? Can anyone please advise? Is it not a simple AR-11 form that has to be filed? Are the requirements for change of address different once labor certification is done.

My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.
My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

Hi,
This question is to all attorneys for their input on whether there will be another window (or something called pre-filing) for all GC applicants waiting for file their I-485. It would be great if there could be 'pre-filing' with eligibility for EAD since H1 renewals are becoming tougher by the minute.
Attorneys please add your comments if there is a probability of this happening and if not is there any way we can request USCIS to consider?

Our lawyer received the RFE and forwarded to us (I am not sure if we also are supposed to receive a copy of the RFE directly from USCIS but we did not). We replied to it and the lawyer sent it to USCIS this week such that it would have been received by USCIS on 1 Jul 09(Wed). I was expecting to see a status change to something like "Response to request for evidence received, and case processing has resumed". However, the case status changed to "Document mailed to applicant".
I am puzzled with this. Does anyone have a similar experience? Any guess what it might be?
Just getting anxious.

I have filed a 485 since i married a citizen. I have had my interview with the immigration officer, since my application is 2 years old (do to the excesive moving ive done) she asks me for another medical and a co-sponsor. Medical is no problem, but i cannot produce a co-sponsor. i need a co-sponsor because my wife has 5 kids from a previous marriage, and the household income does not meet that of the guidelines. We do not have any relatives or friends that can help. I have to submit this information by Jan 21 2009.
What are my alternatives?
