    Few friends of my whose PD were in 2003 had got their GC no matter the current opening is for Jul2001, since you have already applied for ur I-485, I think it would be better for you to wait & watch for some more time and join company B on EAD with contract to hire position.
    Or else you can start ur EB2 processing also through Company B and then later I think there is a way to make us of PD of EB3 when filling for ur I485.

    Hi,

    Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
    I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

    I had a question about using using AC21.

    Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
    If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?

    Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?


    Please advice!

    sir, if you have worked 180 days for this employer after filling of 485, there are no issues with CIS, atleast legally. However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy.     I am writing this Blog entry from my conference of the American Immigration Lawyers Association in Washington DC. In this past few days Immigration lawyers from across the nation gathered here in DC to share ideas and discuss our Immigration laws and policy. On Thursday not so far from our conference, the President (maybe he planned it), discussed Immigration reform for the first time in months.

    President Obama stepped back into the political minefield of immigration policy Thursday, arguing for big changes in what he called a "broken" immigration system. But he warned that no such changes are possible without some Republican support.

    From months now, Latino activists have been pushing the president to make good on his promise to overhaul the nation's immigration system. Thursday, in a speech at American University here in DC, Mr. Obama took up the challenge.

    The speech followed meetings earlier in the week with immigration activists and Latino lawmakers.

    To those concerned with security along the southern border with Mexico, Mr. Obama said, he's already put more boots on the ground than ever before. But, he argued, border enforcement by itself will not stop the flow of illegal immigrants.

    Immigration is back in the spotlight now thanks to a new Arizona law requiring police to question anyone they suspect of being in the country illegally. Mr. Obama says he understands the frustration that led to that law, but he thinks Arizona went too far. His speech helped to lay the groundwork for an expected legal challenge by the Justice Department.

    These are exciting times for all of us at the Immigration Bar, and being here in Washington makes you feel like part of the debate. I promise to keep you updated as we hear from USCIS officials and other government representatives on upcoming changes and other issues.

    Just curious How Fast???

    I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

    Yes. Every single day spent outside the country can be taken into account. Even though, I was never in danger of reaching the 6 year period, when I applied for my 7th year extension, USCIS did include 6 weeks of vacation time to my approval.

    I have been waiting for EAD for the last 120 days. I had an info pass inquiry last month. I was told that my I- 765 and AP applications are on hold because of back ground check. Please advice can I get interim EAD from Detroit office while my application is on hold. I have info pass inquiry for next week for Interim EAD, will Detroit USCIS office help me out OR just another endless waiting time. I don�t know what to do, I have been out of work for last 4 months because of work permit. Can anybody advice me, what should I do. I have applied for I-485. Thanks

    Q's is will it have any impact on 485 process for the employees in case of any issues in the company in other areas ?

    What if the validity date of H1 is before the validity date of F1. In other words if the validity date of H1 is 10/1/2009 to 9/30/2012 and the validity date of F1 is 12/15/2009 to D/s but the approval date of F1 is on 7th Jan 2010 and the approval date of H1 is on 14th jan 2010.

    Hi,

    Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

    I don't know if the following information is applicable if the GC is denied.

    Last year, my friend started working on an EAD (after his H-1B visa expired). Unfortunately, he did not get his renewal EAD in hand before the expiry of the current EAD, so the lawyer submitted a H-1B petition to use the unused portion (India vacations for him, but basically any time when you were outside the US) from his old H-1B so my friend could continue working. If I remember well, it was applied under Premium Processing, but I know for sure that it definitely came through. But so did his EAD card...on the day his current EAD expired.

    Again, I want to reiterate that I don't know how the above scenario plays out if the GC is denied, so do check with a lawyer.

    If My Project with company "A" is over and they are sending me back to india, but before going back i file transfer with company "B", once "B" gets the approval i can come back.

    Can it be done this way?? i mean after transfer is filed can anyone go back to india or He/she has to be in US during this period??

    If the new address is not with in acceptable distance, as per DOL, your employer need to start the process all over again for the new location. Since i-140 approved you can recapture your PD from 2007.

    I have approved I-140 with PD MAY07 awaiting date to be current to file I485, now my company is moving to a new address,

    Can anyone please tell me what will be the impact on my GC process and what I need to do? Appreciate your help on this.

    All,

    I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)

    Do I need to worry about this? any advice/suggetion?

    You dont need to worry about this. This is pretty common.
